Hong Kong's Communications Authority has ruled in favor of a consumer who says Hutchison Telephone Company Limited engaged in misleading sales.
The CA considered a complaint filed on June 13, 2012, by an unnamed consumer against HTCL for breaching section 7M of the Telecommunications Ordinance. The complainant alleged that HTCL's salesperson had engaged in misleading or deceptive sales conduct by not disclosing to him the data speed restriction under the mobile service plan being promoted to him, thereby contravening section 7M of the TO.
Having considered the findings of the investigation conducted by the Office of the Communications Authority, the CA ruled that HTCL had engaged in misleading or deceptive conduct in breach of section 7M of the TO. The CA concluded that a financial penalty of HKD60,000 imposed on HTCL was proportionate and reasonable in relation to the breach concerned.
