Shenzhen will amend its salary payment rule to ensure that employees receive their pay when they take statutory leave.
The new rule will adopt the concept of "normal work time salary" and replace the controversial "standard salary". It states that employees are eligible to take annual leave, home leave, marriage leave, funeral leave, maternity leave, carer's leave, and family planning leave as well as other legal holidays and they must be paid when taking such leave.
Another important change of the new rule is that it requires the minimum salary of workers to be adjusted at least once every two years instead of annually. This change is help reduce pressure on employers.
The rule, which also covers people working for non-enterprise organizations, states that employers who do not provide pay slips to their employees shall be fine from CNY10,000 up to CNY50,000. While those that pay workers less than the minimum standard salary or defer salaries or pay them with tangible goods instead of cash will be fined from CNY30,000 up to CNY50,000.
